Rule 145
Provisions relating to procurement under special circumstances
(1) When purchasing in accordance with Section 66 of the Act, the public body shall prepare a written description of the purchase requirement, quality, quantity, condition and period of completion of the work and compete as much as possible only for the quantity and time period necessary to face the emergency situation or only one builder, supplier , the consultant or service provider should take a written price or proposal and negotiate for a fair and reasonable price.
(2) If the purchase is made in accordance with sub-rule (1), the following documents should be kept in the records as per rule 149:-
(a) Particulars relating to special circumstances,
(b) Failure to immediately purchase would endanger public safety, welfare and community health,
(c) Reasons and grounds for not adopting other methods of procurement.
(3) Pursuant to sub-rule (1), if a public body purchases more than ten million rupees, such body shall publish a public notice of the details of such purchase and shall send the same information to the Public Procurement Monitoring Office.
(3a) In the case that the office as per sub-rule (1) has not been established, the central level public body as per sub-section (1) of clause (b) of section 2 of the Act shall enter into a structural agreement through open bidding and purchase essential medicinal goods and stationery or stationery required for office operation. can do The documents related to the bidding process and the structural procurement agreement model for such procurement will be as approved by the Public Procurement Monitoring Office.
